Madonna Sued Over Material Girl Fashion Line

Even though it's her longtime nickname, Madonna may not have the right to use the phrase "material girl" for the clothing line she started with daughter Lourdes. According to TMZ, a company called L.A. Triumph, Inc. recently filed suit against Madonna claiming that she misappropriated the Material Girl name for her clothing line.
Triumph claims in the lawsuit that it's been selling clothes under the Material Girl name since 1997, earning millions of dollars on the phrase. The suit claims that Madonna — who released the conspicuous-consumption song "Material Girl" in 1985 — has illegally infringed on their trademark for use in the pop star's Material Girl clothing line for juniors that was launched earlier this year.
The Madonna line rolled out in New York in early August, with shoppers greeted by a line of Madonna look-alikes, free cupcakes and a free show by spokesmodel Taylor Momsen.
"I always have two reactions when Lola comes into my room with an outfit on: One is, 'Oh my God, she looks amazing, what incredible style.' And then my second reaction is, 'She's dressed completely inappropriately for school,' " Madonna told People about her 13-year-old daughter's style, which was an inspiration for the line. "I usually tell her to take off her three-inch or six-inch platforms and pull her skirt down just a little bit and take off some of the black eye makeup. ... My role is really to make sure we were all going in the right direction ... and it was a line that I could stand behind and be proud of and feel good about and one that she could also feel represented her. ... I really like the way Lola dresses, and I think this line is absolutely an extension of her taste."
A spokesperson for Madonna had no comment on the lawsuit at press time.
The company wants a Los Angeles judge to issue a declaration that Madonna's use of the phrase creates "deception" in the marketplace. It is also asking the judge to order the singer and her company to turn over all the profits they've made so far on the line.

Usher's VMA-Nominated 'OMG' Inspired By '80s Sci-Fi Character

Director Anthony Mandler wanted to let R&B superstar take viewers 'on a journey, not a ride.'By Jayson Rodriguez

For a video as forward-thinking as Usher's "OMG" -- with its laser beams and light flashes -- director Anthony Mandler actually looked back for inspiration.
"The original idea was kind of Max Headroom," Mandler told MTV News, citing the animated science-fiction character from '80s British TV. "That's where it came from — the TV flickering on and there's this character. We just wanted to bring it up to date."

"Max Headroom was always in his room," he continued, "this unidentifiable room, '80s shapes. I used that for inspiration."
The formula worked: "OMG" is among the Best Male Video nominees for the 2010 MTV Video Music Awards. The clip is up against Drake's "Find Your Love," Jason Derülo's "In My Head," Eminem's "Not Afraid" and B.o.B's "Airplanes." Mandler is a multiple nominee, having also helmed Drake's video.
"OMG" is the first time Usher and Mandler — who has worked with Jay-Z, Mary J. Blige and Rihanna — collaborated on a project.
Usher said he knew the video would be a challenge and wanted to make sure the director was up to the task.
"When I first shot the song to him, I was like, 'Are you sure you're gonna be able to catch this one?' And he said, 'I got it,' " Usher explained.
"We wanted to bring Will.I.Am (the song's producer) into my world," he continued. "Obviously, the international sound and look and feel has already been set, but we wanted to do something theatrical, fun and energetic to show us working off of each other and playing off of each other as artists, but the cinematography would be artistic and incredible."
Mandler described the visuals as "Hitchcock-ian." Though the style of the shot was important to the director, he had a simpler goal in mind: to capture Usher in his element. He said the key to the clip was simply letting Usher's talent take over.
"The concept was to create a world where we put Usher in a space where he does what I think he does better than anyone else in the world, which is perform at a level and magnitude of a superstar and take us, the viewer, whether audible or visually, on a journey, not a ride," the director said. "And, in that, I wanted to create an unpredictability, so one set leads to another and another, and you never know what's gonna happen. Along the way, Usher becomes our guide. We're so focused on him, we don't notice the change. The thing is unfolding little by little, and you can't quite see far enough ahead to know what's gonna come next."
The 27th annual MTV Video Music Awards will be broadcast live from the Nokia Theatre in Los Angeles on September 12. The party starts with MTV News' VMA Pre-Show at 8 p.m., followed by the main event at 9 p.m. ET. He's known as one of the smoothest R&B sensations to grace the stage, but when Usher was 17, he grappled with a far less flattering image.
"I went through this phase where I had really, really bad acne," the singer admits on the latest episode of "When I Was 17," premiering Saturday at 11 a.m. Usher, who was 17 in 1995, reveals with a grin that his nickname was "Pizza Face."

"His acne was so horrible," recalled one of Usher's more blunt friends, Keith. "His face was so jacked up."
Music mogul and producer Jermaine Dupri remembered how the entertainer's spotty complexion led him to shy away from the spotlight.
"He didn't want to go out. He wanted to stay in," Dupri says. "He was a little ashamed of what was going on with his face."
The singer went to extreme, and ultimately unsuccessful, lengths to disguise his breakouts.
"As a dude, you're not gonna put makeup on your face, right?" Usher said. "I tried that, it didn't even work."
He may have experimented with cosmetics and spent a few more nights at home but the multiplatinum star didn't let his acne hold him back from wooing the ladies. "I was 17, so I would still try to talk to girls [and] get past it," Usher reasoned.
He even had some smooth lines to drop when he wanted to draw attention away from his skin. " 'Don't look at that, look at my eyes, baby. I'm trying to say something real serious to you right here,' " Usher recalled, reenacting his complexion-deflecting dating moves. "I know I have pizza face, I don't care."
In the end, his skin cleared up and the singer said it was just a matter of riding out a rite passage that many teens are forced to endure.
"This is something that all 17-year-olds have to deal with," Usher said. "You can't run away from it."

With Backward Guitars, Kasabian's Next LP Might Not Be As 'Reason'-Able

"Our next record is gonna be like Marc Bolan [on drugs] ... with Dr. Hook, you know what I mean?" Kasabian singer Tom Meighan asked recently.
Um ... yeah ... sure. (Both somewhat prominent in the '70s, Bolan was the frontman of British glam-rock stars T. Rex, while Dr. Hook led a satirical country-pop band called Dr. Hook & the Medicine Show. But together and on drugs?) Perhaps you could expand?
"It's gonna be a sexier album," Meighan continued. "It's gonna be organic, not gonna be so choppy as the first record. We're looking forward to it man, it's gonna be a good challenge for us."
Kasabian, the U.K. dance-rockers whose self-titled debut has sold a million copies worldwide with help from the singles "Club Foot" and "L.S.F. (Lost Souls Forever)" (see "Kasabian Mix Big Riffs And Dance Beats To Make Noisy Love During War"), have talked with Noel Gallagher about collaborating (see "Oasis Might Work With Kasabian, Unless It Was Just The Beer Talking"), but will more likely work again with Jim Abbiss (the Music, David Gray).
"Our first record, we had all the songs on computer man," Meighan said. "We thought we'd just chop it up a bit and play it back instead of being the same old plug-in. [With the new tunes] the drums are live ... and we've got these beautiful backward guitars. ... It's a vibe album. This record is gonna be incredible."
Kasabian are not exactly moving on to the next record yet, however. First the band will release Stateside single "Reason Is Treason," named after a quote guitarist/singer Sergio Pizzorno read while recording.
"I wouldn't say we're political, but at the time we'd written that song, things were going on in the world that wasn't right," Meighan said. "I think Sergio just put that in a rock and roll record, with this kind of uptempo, honky-tonk style."
The band is piecing together live footage for the "Reason Is Treason" video and released a concert album, Live From Brixton Academy, on their Web site.
"It's kind of a treat for the fans," Meighan said. "It's just something nice to have [to mark the end of the tour]. We've been playing the same songs for the last year and a half, [and we've] been on the road [for] 18 months, so it's been quite an adventure."
Once the new album is finished sometime next year, Kasabian plan to spend even more time touring America than with their debut.
"We're just putting our foot in the door and if we don't get it this time, we'll get it the next time we come around," Meighan said. "There's still people who haven't heard us and it's so f---ing huge, but we'll get it. We've just gotta keep working. America's about working. You gotta work here."

The prosecution is wrapping up its case against Michael Jackson in what's expected to be the last week of testimony against him. The singer's lawyers argued in and out of court on Monday, trying to convince the judge not to allow the testimony of Jackson's ex-wife Debbie Rowe (they lost that one), and fighting with each other outside of court. Neither Thomas Mesereau nor Brian Oxman would comment on their argument, but it was later learned that Oxman would no longer be on the defense team as of Thursday. In the meantime, another one of the "Neverland 5" — former employees who claim they witnessed Jackson molesting various boys and lost their jobs after testifying before a grand jury — took the stand. Kassim Abdool testified that he witnessed Jackson kissing the 1993 accuser. ...
An airborne bottle cut rock band Kasabian's set short Friday night at the Academy in Glasgow, Scotland, after an audience member pitched the projectile at guitarist Sergio Pizzorno's head, leaving him with a sizable gash that required six sutures. In a statement, Pizzorno said it was "a shame the actions of one person put an end to our best gig all year" and recommended that those who see the band live in the future, should they feel the urge to throw anything, "throw bras and knickers from now on." ...
For Shakira's new video for the dancehall-flavored "La Tortura," she worked with director Michael Haussman (Kanye West, Madonna) to create a combative moment in a couple's relationship. Filmed in an art deco building, her significant other, played by Alejandro Sanz, sings about his "transgressions" en Español while Shakira fires back that she won't forgive him. The clip debuts Tuesday at 6 p.m. on MTV, while her album, Fijacion Oral Part 1, is due June 7. ... Ricky Martin, moved by his visit to the tsunami-ravaged villages of Southeast Asia, is partnering with Habitat for Humanity to help build and restore 224 houses in Thailand's Pang Nga province. A donation from the Ricky Martin Foundation will help more than 1,000 people move out of temporary shelters and overcrowded camps. Work is expected to begin this month and be completed in March 2007. The singer's spokesperson said Martin will make another trip to lend a hand in the rebuilding process. ...
You Hear It First band and Fred Durst protégés Ringside will open for Weezer from April 26 in Vancouver to May 14 in Atlanta. The tour marks the first outing for the duo of singer/songwriter Scott Thomas and producer/actor Balthazar Getty. ... Claymates can now show their admiration for Clay Aiken every time they make a purchase. Two months after 32-year-old Tracey Gardner-Tetso failed to meet up with friends at a Mötley Crüe concert in Washington, D.C., the band is stepping up to match the $10,000 reward put up by the Victims' Rights Foundation. "We hope our involvement helps brings more attention to this case and anyone with information will step forward," bassist Nikki Sixx said in a statement. Tetso is white, 5 feet 4 inches tall, weighs 130 pounds and has long blond hair and blue eyes. She was last seen driving a 1996 black Pontiac Trans Am with tinted windows and Maryland plates LRN 534. On Friday (April 22), three days after guitarist Bryan Ottoson's body was discovered on the band's tour bus, American Head Charge posted a statement on their Web site about their bandmate's passing. "Bryan was a vital member of our group and a key songwriter on The Feeding," the statement reads. "It is our intention to honor his memory by rejoining Mudvayne, one of Bryan's favorite bands, on the current tour. Words cannot convey the depth of our sadness, but we want our fans to be able to hear the music Bryan loved so much. He'd be pissed if we didn't continue on. We will return on the Lubbock, Texas, date on April 29. Chad Ottoson, Bryan's brother, states that the Ottoson family firmly stands behind [American Head Charge]'s decision to carry on in Bryan's name." A spokesperson for American Head Charge said the group is currently working to find a replacement guitarist and will make a decision by Monday. Meanwhile, a public memorial service for Ottoson will be held from 6-8 p.m. on Tuesday at the Thomson Dougherty funeral home on Park Avenue in Minneapolis. ...
Lindsay Lohan's Los Angeles home was robbed while she was in New York shooting "Just My Luck," according to Los Angeles police. Kinks frontman Ray Davies, who is currently on tour, failed to testify against the man who allegedly drove the getaway car for the gunman who stole Davies' female companion's purse at gunpoint and shot the singer in the leg during a January 4, 2004, attack in New Orleans. The defendant was released Wednesday after the prosecution dismissed charges, The Associated Press reports. The district attorney for the case said Davies had informed them of his unavailability until December. The DA said they plan to reinstate charges once the singer returns and is able to testify against the accused. ... Mathew Knowles' Sanctuary Urban Group will release an album of unreleased music from the late Rick James on August 2. The record will include a duet with Ty James, Rick's daughter. ...

50 Cent is readying a re-release of The Massacre this summer so that he can include a video for every song as well as some new tracks. According to Fif's label, the new additions aren't set yet, but may include anything from anyone in the G-Unit family. And that family is about to grow by four men: the members of Mobb Deep and M.O.P. Though their record deals haven't been inked yet, it looks like the only thing holding them up are business technicalities. ...
Several Detroit luminaries came out to Tuesday night's NBA Finals game between reigning champs the Detroit Pistons and the San Antonio Spurs. Eminem, Kid Rock and Anita Baker all cheered on the Pistons as they took game 3. ... Marc Anthony is hitting the road once again, and this time around he's bringing a couple of friends with him. The Latin-music superstar is teaming up with fellow crooners Alejandro Fernandez and Chayanne for a 15-city cross-country trek that will kick off August 15 in Houston and wrap September 17 in Miami. ...
What's good enough for Britney Spears is apparently good enough for Michael Jackson and his family. The Hollywood Reporter reports that a six-episode reality show revolving around the pop-music clan has been pitched to a number of networks, including ABC, FOX and A&E. According to the pitch, the show — which was being shopped around a week before Jackson was acquitted on charges of child molestation — would offer a behind-the-scenes look at how the family rallied around Michael following his indictment in November 2003 and the family's attempt to rehabilitate their public image. ... Santa Barbara County District Attorney Tom Sneddon told NBC's "Today" on Wednesday (June 15) that Jackson's young accuser is having a "difficult time" coping with the pop star's acquittal. The prosecutor spoke with the boy immediately after the not-guilty verdicts were announced on Monday. "He's very down and he's having a difficult time understanding why people didn't believe him," Sneddon said. ...
A few weeks after surgery to remove a lump from her breast, Australian singer Kylie Minogue posted a message on her Web site thanking her fans and assuring them that she will return. "I am getting through this one step at a time, and your messages of love and support have been greatly appreciated," Minogue, 37, wrote on Monday. "Rest assured I am being well looked after, though it will be a long road ahead. I will be receiving future treatment on my return to Europe." She also said she was heartened to hear that since her diagnosis, thousands of women have become more aware of breast health and many young women have signed up for breast exams. ... The Pixies' highly influential 1988 album, Surfer Rosa, has finally reached gold status, meaning it has sold 500,000 copies. The band was presented a plaque at its Monday show in Washington, D.C. This is only the group's second gold album; Doolittle, released in 1989, was certified gold in 1995. ... Dinosaur Jr. have added a leg of West Coast dates to their summer tour, beginning August 13 in Las Vegas and ending August 22 in Vancouver, British Columbia. The first leg begins July 7 in Orlando, Florida ... After playing with both the Pixies and Dinosaur Jr. (and many others) at Lollapalooza in Chicago, Liz Phair will hit nine cities on an acoustic tour. The outing, which will feature tunes from the singer/songwriter's upcoming fifth album (due in September), begins July 26 in Boston and ends August 19 in San Francisco. ...
Drowning Pool's manager has confirmed that the band has chosen a replacement for vocalist Jason "Gong" Jones, who left the group this past weekend, two years after taking over for the late Dave Williams. An announcement is expected in the coming weeks, after the band works out some last-minute details. The new singer is "not an unknown," according to the manager. ... HMV stores in Canada pulled all of Alanis Morissette's albums from their shelves on Monday as a protest to the Ottawa-born artist's deal with Starbucks to sell her new acoustic version of Jagged Little Pill. The coffee chain has the exclusive rights to peddle the CD for the next six weeks, after which it will be offered to traditional music retailers. ...

Shakira Meets With Haitian Earthquake Survivors

More than three months after a massive earthquake devastated Haiti, pop singer Shakira visited the island on Sunday to make good on her pledge to build a school for the island nation's children.

Looking for a suitable site for the school for needy children to be built by her Pies Descalzos (Barefoot) Foundation in the capital of Port-au-Prince, The Associated Press reported that Shakira touched down on a golf course that has become a makeshift camp for more than 50,000 homeless quake survivors. In addition to greeting fans and infants living at the Petionville Golf Club, Shakira met with actor Sean Penn, who has been working on disaster relief on the island since the quake struck on January 12.
Shakira, who took part in MTV's Hope for Haiti Now telethon in January, met with 100 children at the site of her Barefoot Haiti school, an offshoot of her foundation's efforts in Colombia, where the organization provides nutrition, education and psychological support to more than 6,000 children displaced by violence.
"We've come to make all the preparations to be able to start the building of a Barefoot school here in Haiti," Shakira told Reuters about her latest effort. "We think we can employ what we've learned [in Colombia] here, apply it in this country which needs it so much at the moment."
With a potential 300,000 people killed and more than a million left homeless, many of them young orphans, the Haitian earthquake is considered one of the worst natural disasters in modern history. The singer said she believes that providing education to the many displaced and orphaned Haitian children is a key part of the reconstruction efforts.
"We need to think about the future of this country and of how Haiti's children can be useful to their societies tomorrow," she said. "Education is one of the fundamental tools with which to develop and rebuild Haiti."

Nas To Pay Kelis $51,000 A Month In Support

A Los Angeles Superior Court judge ordered rapper Nas on Wednesday to increase his monthly child- and spousal-support payments to estranged wife Kelis and their infant son, Knight.

According to The Associated Press, Judge David Cunningham III ordered the rapper (born Nasir Jones) to bump up his monthly child and spousal payments to $51,101, for a total of more than $600,000 a year. Nas has been paying a court-mandated $40,000 a month since July.
The decision to increase the payments to Kelis and Knight came after a two-day hearing in which Cunningham determined that the New York MC made enough money in recent months to pay additional support. Nas' attorney, Mark Vincent Kaplan, said the judge made the right decision and that despite the payment bump, Nas came out ahead in the decision because he will no longer have to pay the expenses on the former couple's Los Angeles residence.
TMZ reported that during Wednesday's hearing, Kelis said that the couple — who announced their intention to divorce in April after a four-year marriage — attempted to reconcile in September to no avail. She also reportedly testified that she has been having difficulty earning money because she is a new mother and doesn't have a lot of job options outside of the music business. She told the court that Nas is slated to release two albums in 2010.
Earlier this week, Kelis, who recently signed a new record deal with Interscope through the Will.I.Am Music Group, told MTV News that she has been working on a new album with a "futuristic disco" sound, largely inspired by her pregnancy and the birth of Knight.

Justin Timberlake To Voice A Gay Character On 'The Cleveland Show'

Justin Timberlake has been hard at work building his Hollywood career and will show off his acting chops once again in an upcoming episode of "Family Guy" spin-off "The Cleveland Show."
Fox reps confirmed to MTV News that Timberlake will voice two characters: Paul, the boyfriend of Terry (voiced by "Saturday Night Live" and "30 Rock" actor Jason Sudeikis), as well as a "singing booger" belonging to Cleveland's stepson Rallo, aptly named "Booger." The episode is scheduled to air in February 2011.
Timberlake is already earning rave reviews for his work as Paul. "Terry falls in love with a guy voiced by Justin," "Cleveland" creator Rich Appel told Us Weekly. Appel added that Timberlake turns in a hilarious performance: "Justin is just hysterical!"
Timberlake's voice-over work is just the latest in a range of roles for the singer-turned-actor. He has reportedly been offered a role opposite Amanda Seyfried in the sci-flick "I'm.mortal," in which people don't get older than age 25. The singer has also been spotted filming the flick "Friends With Benefits" with Mila Kunis in New York and will hit the big screen in the David Fincher-helmed movie "The Social Network." Timberlake plays Napster co-founder Sean Parker, who had a hand in the launch of the social-media phenomenon Facebook.
Timberlake told MTV News last year that he was excited to work with Hollywood heavyweights Fincher and Aaron Sorkin on "The Social Network." "To be honest, David Fincher is so ridiculously genius that we're all just following his lead," Timberlake said. "I think we want to tell the story, and I want to tell it through Sorkin's words and Fincher's eyes. I think Aaron did a lot of research on all of it. I don't want to speak for another actor, but I think the consensus for all of us is that we just want to make a great film."

Did Lady Gaga Have Any Impact On 'Don't Ask, Don't Tell' Vote?

In spite of DADT vote stalling in Senate, supporters of repeal say Gaga's tireless advocacy has garnered issue global recognition.By Gil Kaufman

There are many different ways for celebrities to leverage their notoriety to help a cause. They can play a concert, write a check, make a PSA or, as in the case of actor Sean Penn, live in a meager tent in an earthquake-ravaged country for six months and run their own relief organization. But few stars have given as much in as short a time as Lady Gaga has to the cause of repealing the U.S. military's "don't ask, don't tell" policy.

"The reality is that on Saturday night we were looking at what we could do on Monday, knowing that even if we sent out an alert to our base of 80,000 supporters, we'd be talking to the same people," said Trevor Thomas, spokesperson for the Servicemembers Legal Defense Network, a national organization dedicated to ending DADT. "We wanted to expand our reach and reach more people nationally and, more than anything, the two swing senators [in Maine] who could give us a chance."
The SLDN quickly hatched a plan to organize a rally in Maine on Monday in an attempt to get swing-vote Republican Senators Olympia Snowe and Susan Collins to possibly change their votes on the repeal. That's where Lady Gaga came in. The pop icon had walked the white carpet at the VMAs with four SLDN members, shouted them out from the stage, turned her website over to the issue and posted public video pleas about the issue. When word came of this last-minute appeal, once again, she stepped up.
According to Thomas, the singer finished a show in Raleigh, North Carolina, on Sunday night, hopped on a bus and took a 15-hour ride to Maine, personally writing her address on the way.
"The dedication from her was amazing," he said. "She wrote the speech, did the research and talked to people, and it did exactly what we need to do — highlight the issue to young people and others who might not have heard about this cause. But most importantly, we did it in this key area we needed it in."
The Gaga speech garnered massive local and national coverage for the issue, with stories in the Denver Post, USA Today and The New York Times, among others. "You can work for months to place one story in the Times' print section, and even if politics prevail and we lose the vote, more people know about the DADT repeal than did yesterday," Thomas said.
And while Gaga's mighty push to lock in the necessary votes didn't save the day when the crucial Senate vote took place on Tuesday (September 21), Thomas said her help undoubtedly had a huge impact and put a global spotlight on the policy.
From the night Gaga first spoke out on the repeal at the 2010 VMAs and redirected traffic from her official website to the SLDN site until 8 a.m. on Tuesday morning, Thomas said, 314,446 people clicked to the "take action" tab, which sent them to a site listing the phone numbers where U.S. senators could be reached about the vote. While it's unknown how many of those clicks turned into actual phone calls, Thomas said he was "100 percent sure" that the site would not have gotten nearly that many visits without Gaga's efforts.
The total number of visitors was nearly four times the amount of supporters SLDN had gathered pre-Gaga, but Thomas pointed out an even more impressive number. During that same two-week period, the pages on the SLDN website with background information on DADT got 520,298 page views. In contrast, during the first two weeks of the month, the site had 13,000 visitors and 30,000 page views.
"There are many people who are high-profile who speak out in a positive manner on LGBT issues," Thomas said. "But the difference here is she asked, 'What can I do?' at a time when it was critically important for the passage of our bill. Not only did she say that, but she asked how and when to do it. When you look at the past couple of weeks, you see not just strategic tweets but the video address that hit days before the critical vote and which was driving many calls to the Senate switchboard. I don't know of many entertainers who at the critical moment for a bill would stop their website and direct it to a 'take action' page for a relatively small group trying to push an issue crucially important to servicemembers and those who support them."
Before Tuesday's vote, Jim Manley, a spokesman for Senate Majority Leader Harry Reid — the Nevada senator exchanged DADT-related tweets last week with Gaga — said the Democratic boss welcomed Mother Monster's advocacy. "We appreciate the support of Lady Gaga and her supporters," Manley said. "Sometimes that can have an impact, especially when you are as apparently committed as she is to the cause."
Even with all of Gaga's work, CNN reported that both Collins and Snowe said Gaga's appearance at Monday's rally in Maine had no effect on their crucial votes; the final 56-43 tally helped ensure that the Senate would not open a DADT repeal discussion during its current session. Collins, in fact, supported the repeal, but told the network she felt she had to stay in line with her colleagues and vote against debate for procedural reasons.
